I. General Terms and Conditions

§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts that you conclude with us as the provider (Thefreeway Sportswear®) via the website www.the-freeway.com. Unless otherwise agreed, the inclusion of any own terms and conditions used by you is rejected.
(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor self-employed professional activity. An entrepreneur is any natural or legal person or a legally capable partnership that acts in the exercise of its self-employed professional or commercial activity when concluding a legal transaction.

§ 2 Conclusion of the Contract
(1) The subject matter of the contract is the sale of goods.
(2) By placing the respective product in our online shop, we submit a binding offer to conclude a contract under the conditions stated in the item description.
(3) The contract is concluded via the online shopping cart system as follows: The goods intended for purchase are placed in the "Shopping Cart". You can access the "Shopping Cart" via the corresponding button in the navigation bar and make changes there at any time. After accessing the "Checkout" page and entering your personal data as well as the payment and shipping conditions, the order details will finally be displayed as an order overview. Before submitting the order, you have the option to review the information again, change it, or cancel the order. By submitting the order via the "Buy" button, you declare legally binding acceptance of the offer, whereby the contract is concluded.
(4) The processing of the order and the transmission of all information required in connection with the conclusion of the contract is carried out by e-mail, partly automatically. You must ensure that the e-mail address provided to us is correct and that the receipt of e-mails is technically guaranteed.

§ 3 Prices and Payment Conditions
(1) The prices listed in the respective offers as well as the shipping costs are total prices. They include all price components, including all applicable taxes.
(2) The applicable shipping costs are not included in the purchase price and can be accessed via a correspondingly designated button in our online shop. They are shown separately during the ordering process and must be borne by you in addition, unless free shipping has been promised.
(3) The payment methods specified in the online shop are available to you.
(4) Unless otherwise stated for the individual payment methods, payment claims arising from the concluded contract are due for payment immediately.

§ 4 Delivery Conditions
(1) The delivery conditions, delivery date and any existing delivery restrictions can be found under a correspondingly designated button in our online shop or in the respective item description.
(2) If you are a consumer, it is legally regulated that the risk of accidental loss and accidental deterioration of the sold item during shipping only passes to you upon delivery of the goods, regardless of whether the shipment is insured or uninsured.

§ 5 Statutory Liability for Defects
(1) Statutory liability rights for defects apply.
(2) As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects and transport damage, and to notify us and the carrier of any complaints as soon as possible. Your statutory warranty claims remain unaffected by this.
(3) If a characteristic of the goods deviates from the objective requirements, the deviation shall only be deemed agreed if you were informed by us of the same before submitting the contractual declaration and the deviation was expressly and separately agreed.

§ 6 Right of Retention, Retention of Title
(1) You may only exercise a right of retention insofar as it concerns claims arising from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.

§ 7 Choice of Law, Place of Performance, Place of Jurisdiction
(1) German law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country of the consumer’s habitual residence.
(2) The place of performance for all services arising from the business relationships existing with us, as well as the place of jurisdiction, is our registered office, provided that you are not a consumer but a merchant, a legal entity under public law or a special fund under public law.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

§ 8 Alternative Dispute Resolution
The European Commission discontinued the ODR platform as of 31 December 2023. In the event of a dispute, consumers may contact the General Consumer Arbitration Board, Straßburger Straße 8, 77694 Kehl am Rhein (www.verbraucher-schlichter.de). We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

(1) The contract language is German.
(2) We do not store the complete contract text. Before submitting the order, the contract data can be printed using the browser’s print function or saved electronically. After receipt of the order by us, you will receive the order data, legally required information for distance contracts and the General Terms and Conditions again by e-mail.
