Privacy – Returns & Electronic Withdrawal
This notice supplements our general Privacy Policy and explains how Thefreeway Sportswear® processes personal information when you submit a return, exercise a statutory right of withdrawal, or provide return-shipment or tracking information.
Information we process
- first and last name;
- email address;
- telephone or WhatsApp number, where provided;
- order number;
- the product or products concerned, including article, colour and size where relevant;
- the type of request, including return or statutory withdrawal;
- the reason for a return, where applicable;
- additional information you voluntarily provide;
- the date and time at which an electronic withdrawal is submitted and received;
- technical information necessary to document the submission, including the locale or page used where applicable;
- return carrier, shipment and tracking information.
Why we process this information
We process this information to identify you and the relevant order or contract, receive and document return and withdrawal requests, record submission and receipt of an electronic withdrawal, send the required acknowledgment of receipt, communicate with you, identify and monitor returned shipments, receive and inspect returned goods, process refunds or other applicable remedies, maintain appropriate records, and comply with applicable consumer-protection, accounting, tax and other legal obligations.
Electronic withdrawal acknowledgment
When you submit a statutory withdrawal through our electronic withdrawal function and activate the confirmation function, we use the electronic means of communication you provided, normally your email address, to send an acknowledgment of receipt without undue delay. The acknowledgment may contain the content of your withdrawal declaration and the date and time at which it was received.
Legal basis
For customers in the European Economic Area, this processing is carried out where necessary for the performance, administration or unwinding of a contract and where necessary for compliance with legal obligations applicable to us. Where processing is based on consent, you may withdraw that consent in accordance with applicable law.
Service providers
Information relating to returns and withdrawals may be processed by Shopify and by service providers that support our website, communications, customer service, email delivery, shipping, logistics, return processing, hosting, security or other technical operations, where necessary to provide these services and subject to applicable legal and contractual requirements.
Retention
We retain information relating to returns and withdrawals only for as long as reasonably necessary to process the relevant request and thereafter for the periods required or permitted by applicable law, including accounting, tax, consumer-protection and legal record-keeping requirements and where necessary for the establishment, exercise or defence of legal claims. When the information is no longer required, it is deleted, anonymised or otherwise handled in accordance with applicable data-protection law.
