I. General Terms and Conditions

§ 1 Basic provisions

(1) The following terms and conditions apply to contracts that you conclude with us as the provider ( Thefreeway Sportswear® ) via the website www.the-freeway.de . Unless otherwise agreed, the inclusion of any terms and conditions you may use is hereby excluded.

(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

§ 2 Conclusion of the contract

(1) The subject of the contract is the sale of goods.

(2) By placing a product on our website, we make you a binding offer to conclude a contract via the online shopping cart system under the conditions specified in the item description.

(3) The contract is concluded via the online shopping cart system as follows:

  • The goods intended for purchase are placed in the "shopping cart".
  • After clicking the "Checkout" button and entering your personal details as well as the payment and shipping conditions, an order overview will be displayed.
  • By submitting your order you declare your legally binding acceptance of the offer.

(4) Orders will be processed via email. You must ensure that the email address you provide is correct.

§ 3 Retention of title

The goods remain our property until full payment has been made.

§ 4 Warranty

The statutory liability for defects applies.

§ 5 Choice of law

(1) German law shall apply. For consumers, this choice of law shall apply only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country of the consumer's habitual residence.

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.

(2) We do not save the complete contract text. Before submitting the order, the contract details can be printed out or saved electronically using the browser's print function.

4. Prices and payment terms

(1) The prices stated represent total prices. They include all price components including all applicable taxes.

(2) The shipping costs incurred are not included in the purchase price and are to be borne by you unless free shipping has been promised.

(3) The payment methods specified in the respective offer are available to you.

5. Delivery conditions

(1) The delivery conditions, the delivery date and any existing delivery restrictions can be found in the respective offer.

(2) If you are a consumer, the risk of accidental loss and accidental deterioration of the goods sold during shipment shall only pass to you upon delivery of the goods to you.

Where can I find the returns portal?

There is no returns portal .

Shipping costs : to be borne by the customer. Please always use insured, trackable shipping.

How do I return a product?

🛍️ Return policy – 14 days

You have 14 days from receipt of the goods to request a return.

Conditions : Unworn, unused, with tags, original packaging. Receipt/proof of purchase required.

  1. Register return via email / WhatsApp (state order number).
  2. Package the item securely. Include the order number or a copy of the order confirmation.
  3. Send at your own expense using a service provider of your choice to the address above.
  4. Keep the tracking number.

Non-returnable : perishable goods, personalized/custom-made items, care products, hazardous substances/flammable liquids/gases, sale items , gift vouchers.

EU cancellation policy : For deliveries within the EU, you have a 14-day right of cancellation without giving any reason. Conditions as above.

Important : Unannounced returns will not be accepted.

My item is defective. What can I do?

Check your order upon receipt. Report any defective, damaged, or incorrect items immediately.

How long does it take to receive my refund?

Refunds will be made after receipt of goods and quality inspection via the original payment method.

  • Bank/card providers may further delay the credit.
